Giving Simon the death penalty right after he first started fighting the Anti-Spirals didn't make any sense. It was drastic and pointless given how powerful a pilot he was in the previous war.
He didn't even attempt to fight the Anti-Spirals or stop the moon with Simon, just accepted that they would lose.
It would have made more sense if he fought the Anti-spirals with Simon for a few episodes and then have him start making desperate survival based decisions.
