That's why companies lobby legislators to criminalize downloading instead of leaving it as a civil court lawsuit matter. When criminalized, the reporting of the crime can get immediate treatment by your local police or FBI as if it were a criminal case (murder, manslaughter, racketeering, counterfeiting, etc). Instead of a C&D letter, you can be arrested on the first time along with search warrant being served upon your home for other pirated material.
Right now, the next version of ACTA is being worked upon via the TPP (Trans Pacific Partnership) treaty. As with ACTA, it has a lot of hidden anti-piracy provisions that the public is not allowed to know about until it is ratified and maybe not even then. ACTA had wikileaks release info on it, but TPP has been remarkably secure and secret. It just needs a republican senate to ratify it (US senate is the body that ratifies treaties for usa participation).
