I must say this scene bothered me too; not only did he hold the rifle wrong, but he aimed directly at the target instead of behind it as he should have, and the spent casings looked like live ammunition.
That being said, the show is still good otherwise.
He misses when he is holding it correct, than he holds it like that and almost hits.
They weren't spent casings that's why, he kept dropping all the bullets as he tried to reload.

That's not true. It is legal to own some firearms in Japan if you have an appropriate license.
Low, it's a drama/romance mainly. The planes and guns are setting right now, not plot or mechanics. This will probably change once they start doing some shooting, which we know will happen by the prologue (the first couple minutes).
